2. Scope of This Policy

This Policy applies to personal data collected or processed through:

The website, current or future mobile applications, customer and partner portals, online accounts, booking forms, booking offices and centers, telephone calls, email, WhatsApp, social media platforms, advertisements, events and exhibitions, membership and loyalty programs, support services, customer relationship management systems, supplier integrations, and any digital or physical channel used by the Company to provide its services.

This Policy applies to customers, travelers, accompanying persons, visitors, corporate representatives, agents, travel companies, hotels, suppliers, and partners, including users of B2C, B2B, and B2B2C services.

3. The Company’s Role in Processing Personal Data

Depending on the nature of each transaction, the Company may act as:

  1. A Data Controller when it determines the purposes and means of processing personal data.

  2. A Data Processor on behalf of a travel company, employer, supplier, or partner.

  3. A Joint Controller where the Company and another party jointly determine the purposes of processing.

  4. A party responsible for transferring or coordinating the data required to complete a booking through the actual service provider.

The responsibility of each party shall be determined according to its actual role, applicable law, and the agreements governing the relationship.

4. Personal Data We May Collect

4.1 Identity Data

Name, nationality, gender, date of birth, photograph, signature, national identification number, passport number, passport issue and expiry dates, residence permit, visa, and identity verification documents.

4.2 Contact Data

Telephone number, email address, physical address, country of residence, social media accounts, language, and preferred method of communication.

4.3 Travel and Booking Data

Travel destinations, dates, number and ages of travelers, accompanying passenger details, hotels, rooms, meals, flights, transfers, activities, events, assistance requests, and special arrangements.

4.4 Payment Data

Booking amount, currency, payment method, transaction status, transaction reference number, invoice or receipt information, refund requests, and banking disputes.

Payment gateways or banks may process card details directly in accordance with their own systems and policies.

The Company does not request customers to send full card numbers or CVV security codes through WhatsApp or email.

4.5 Visa and Document Data

This may include identity, employment, income, residency, family, banking, personal photographs, booking documents, and other documents requested by embassies, consulates, or visa application centers.

Documents should only be submitted through the secure upload channel designated by the Company, or to documents@elhabashytravel.com when expressly requested by the Company.

4.6 Health Data and Sensitive Requests

We may collect information concerning disability, health conditions, allergies, dietary requirements, or medical assistance where necessary to provide a service requested by the traveler.

Such information is processed only to the extent necessary and after obtaining the required consent or other lawful basis.

4.7 Technical Data

IP address, device and browser type, operating system, device and session identifiers, login and usage records, pages visited, technical errors, and security and fraud-prevention information.

4.8 Location Data

Approximate or precise location data may be collected when using a service that depends on location, subject to obtaining the required permission from the user’s device.

4.9 Communications and Customer Service Data

The content of messages, inquiries, complaints, attached documents, and support records.

Calls may also be recorded for quality assurance, training, or transaction verification purposes, after providing any notice required by law.

4.10 Corporate and Partner Data

Company name, details of company representatives, licenses and authorizations, commercial, tax, and banking information, transaction histories, bookings, commissions, and invoices.

  2. From a person making a booking on behalf of family members or accompanying travelers.

  3. From an employer, travel company, agent, or commercial partner.

  4. From hotels, airlines, transportation companies, tour operators, and activity providers.

  7. From payment gateways and banks, to the extent required for transaction processing.

Any person providing personal data relating to another individual confirms that they are authorized to provide such information and that they have informed the relevant individual and obtained their consent where required.

Withdrawal of consent does not affect the lawfulness of processing carried out before withdrawal, nor does it prevent the Company from retaining information that must be retained by law or is necessary to complete an existing booking, document a transaction, or defend a legal right.

8. Data Required to Provide Services

Some information may be optional, while other information may be necessary to complete a booking.

Failure to provide required information, or providing incorrect or incomplete information, may result in the service being unavailable, the request being rejected, or amendment or cancellation charges being imposed by the supplier.

9. Children and Minors

Persons under the age of 18 may not independently enter into a booking or create a financial obligation without the approval of their guardian or legal representative.

Personal data relating to children may be processed where they are travelers included within a family booking and must be provided by a parent, guardian, or other legally authorized person.

Processing of children’s data and sensitive personal data is subject to any additional consents and safeguards required by law.

10. Sharing Personal Data

We may share the minimum amount of personal data necessary with:

  1. Licensed travel companies.

  2. Hotels, resorts, apartments, and accommodation providers.

  3. Airlines and Global Distribution Systems.

  4. Transportation, limousine, and cruise companies.

  5. Tour, activity, and event operators.

  7. Insurance and assistance providers.

  8. Embassies, consulates, and visa application centers.

Hotels, airlines, travel companies, payment gateways, medical facilities, and other suppliers may act as independent controllers of the personal data they receive.

The Company shall not be responsible for their independent practices except to the extent that an error or breach is attributable to the Company, including unlawful disclosure or the transmission of data that is not necessary to provide the service.

Because travel is international in nature, it may be necessary to transfer personal data to the destination country, a transit country, or to systems and suppliers located outside Egypt.

Such transfers are carried out only to the extent necessary and for a legitimate purpose, subject to appropriate safeguards and any approvals, licenses, or authorizations required by law.

13. Marketing and Promotional Communications

The Company may send offers, newsletters, or travel recommendations through email, WhatsApp, text messages, or telephone where appropriate consent or another valid legal basis exists.

Unsubscribing from marketing communications does not affect necessary booking communications such as confirmations, alerts, amendments, or payment-related notices.

Second: Cancellation Policy

This Policy sets out the general rules governing the cancellation of requests and bookings for services offered, arranged, or coordinated through EL HABASHY TRAVEL.

Cancellation terms may vary depending on the service provider, fare type, travel date, and season. Therefore, any specific terms shown in the quotation, payment page, or booking confirmation form an integral part of this Policy.

1. Nature of the Company’s Role

Depending on the nature of each transaction, the Company may act as:

  1. A marketing or listing platform.

  2. A booking intermediary or coordinator.

  3. An agent acting on behalf of the service provider.

  4. A payment collection agent.

  5. A principal contracting party for a specific service.

  6. A service provider delivering a service under its own name and responsibility.

The quotation or confirmation will identify the Company’s role and the actual service provider where necessary.

Services requiring specialized licensing are delivered through licensed entities, travel companies, or authorized suppliers.

2. Specific Terms of Each Booking

A booking may be:

  1. Free to cancel until a specified deadline.

  2. Cancellable subject to a fee.

  3. Non-cancellable or non-refundable.

  4. Amendable only.

  5. Subject to seasonal, group, or exceptional conditions.

If a general term conflicts with a specific term clearly disclosed before payment, the specific term shall apply, unless it conflicts with a mandatory provision of law.

3. Submitting a Cancellation Request

The request should include:

The booking holder’s name, booking number, service to be cancelled, names of travelers, reason for cancellation, and contact details.

A booking is not considered cancelled merely because a request has been submitted.

Cancellation becomes effective only after written confirmation from the Company or the service provider.

4. Timing of Cancellation

Cancellation charges are calculated according to the actual date and time at which the cancellation can be processed in the supplier’s system.

If a request is received outside business hours, during a public holiday, or at a time when the supplier cannot be reached, it may be processed at the earliest available business time, and the charges applicable at the time of processing will apply.

Customers should submit cancellation requests with sufficient notice.

The Company is not responsible for increased cancellation charges resulting solely from a delay by the customer in submitting the request.

5. Cancellation Charges

Depending on the booking, deductions may include:

  1. Supplier cancellation fees.

  2. The value of non-refundable nights or services.

  3. Ticket issuance fees.

  4. Governmental or consular fees.

  5. Non-refundable payment gateway or bank charges.

  6. Transfer fees and currency exchange differences.

  7. The value of work or services already performed.

  8. Disclosed consultation or processing fees.

  9. Non-refundable taxes and charges.

The Company does not impose undisclosed fees or charges that are unrelated to an actual service, cost, or condition previously disclosed and accepted.

6. Non-Cancellable Rates

Promotional rates, early-booking rates, seasonal offers, holiday rates, event-related bookings, or group rates may be non-cancellable.

This condition applies where it has been clearly disclosed before payment or confirmation, without prejudice to any mandatory legal rights.

7. No-Show

A customer may be considered a No-Show if they fail to arrive at the specified time or arrive late enough for the service provider to refuse delivery of the service.

This may result in the loss of part or all of the booking amount, depending on the supplier’s terms.

This may apply to hotels, airports, transfers, tours, events, or medical appointments.

8. Missing Documents or Denied Boarding

The Company is not responsible for cancellation or non-use costs resulting from:

  1. An expired passport.

  2. Failure to obtain a required visa or permit.

  3. Providing incorrect information.

  4. Late arrival for travel.

  5. Denied boarding for security, health, or regulatory reasons relating to the traveler.

  6. Violation of the service provider’s rules.

This does not apply where the cause results from a proven error attributable to the Company.

9. Booking Amendments

Changes to names, dates, destinations, room types, or number of travelers may be treated as a cancellation and rebooking if the supplier’s system does not permit amendments.

The customer is responsible for supplier fees, fare differences, taxes, and any disclosed processing charges.

A request to amend a booking does not guarantee that the amendment will be accepted or that the original price or availability will remain available.

10. Hotels and Accommodation

Cancellation terms vary depending on the hotel, rate type, and season.

Charges may include one night, a percentage of the booking value, or the full value of the stay.

The hotel’s local time zone and cancellation deadline rules will apply when determining the cancellation period.

11. Flights and Transportation

Flight tickets and transportation bookings are subject to the rules of the airline, carrier, and fare class.

Some tickets may be non-refundable, while others may allow only partial tax refunds.

Fees may apply per traveler and per flight segment.

12. Trips, Activities, and Events

Tickets for events, activities, yachts, day trips, and services reserved for a specific date and time may be non-cancellable.

If an event is cancelled by the organizer, the matter will be handled according to the organizer’s policy, which may provide for a refund, an alternative date, or a credit.

13. Visas

Cancellation of a visa application does not guarantee a refund of:

  1. Embassy or consular fees.

  2. Visa application center fees.

  3. Appointment or biometric fees.

  4. Translation or document authentication fees.

  5. Fees for reviewing or preparing an application file where the work has already been performed.

  6. Travel company or supplier fees.

Visa decisions and processing times are determined solely by the competent official authority.

14. Hajj and Umrah

These services are offered, marketed, or coordinated through licensed travel companies and authorized entities in accordance with applicable official regulations.

Cancellations are subject to the terms of the operating travel company, the competent authorities, hotels, carriers, and the applicable seasonal regulations.

15. Medical Tourism

Medical appointments and treatment programs are subject to the policies of the healthcare facility and the relevant accommodation and transportation providers.

Fees for consultations, examinations, or services already performed are non-refundable.

The Company is not responsible for medical outcomes or decisions made by healthcare providers.

16. Cancellation by the Service Provider

If the service provider cancels a booking before it is performed, the Company will, depending on its role in the transaction, work to provide one of the following solutions:

  1. A comparable alternative.

  2. A change of date.

  3. A future credit, subject to customer approval.

  4. A refund of the amount due.

Where the Company is the principal contracting party, it will fulfill its obligations to the customer in accordance with the booking confirmation and applicable law.

Where the Company acts as an intermediary, it will communicate and follow up with the supplier while remaining responsible for its own errors and for any amounts received by it on behalf of the customer.

17. Force Majeure and Exceptional Circumstances

Circumstances beyond reasonable control may include:

Natural disasters, epidemics, wars, civil unrest, border or airport closures, governmental decisions, health restrictions, strikes, dangerous weather conditions, and widespread failures of booking or communication systems.

Each situation will be handled according to applicable law, supplier terms, and the available options, while reasonable efforts will be made to minimize the impact on the customer.

18. Corporate and Group Bookings

B2B bookings, group bookings, tour groups, conferences, and similar arrangements are subject to their own agreements and quotations.

Where a specific commercial agreement conflicts with this Policy, the specific agreement shall apply to the relevant transaction, provided that it does not violate applicable law.

1. Submitting a Booking Request

Submitting a form or message, or making a payment, does not always mean that the booking has been confirmed.

A service may be:

  1. Available for instant booking.

  2. A booking request requiring review.

  3. A pending request awaiting supplier confirmation.

  4. A booking requiring full or partial payment within a specified deadline.

The nature of the request will be stated in the quotation, payment page, or communication sent to the customer.

2. Booking Confirmation

A booking becomes confirmed once the applicable requirements have been completed, including:

  1. Service availability.

  2. Acceptance by the service provider.

  3. Payment of the required amount.

  4. Issuance of a confirmation number, voucher, or ticket.

A message stating “Your request has been received” or a payment receipt alone does not constitute final confirmation where the service remains subject to supplier approval.

3. Prices and Availability

Prices for hotels, flights, and travel services are dynamic and may change until final confirmation.

If the price changes or availability is no longer available before confirmation, the customer may choose to:

  1. Accept the new price or alternative.

  2. Select another service.

  3. Receive a refund of the amount paid for the unconfirmed request.

The Company does not charge a cancellation fee for a request that could not be confirmed due to loss of availability or a price change, unless the Company has already performed a separate service whose fee was previously disclosed.

4. Quotation Validity

A quotation remains valid for the period stated in the quotation and subject to continued availability.

Where no specific validity period is stated, the quoted price remains indicative until supplier confirmation and payment are completed.

5. What the Price Includes

The quotation will specify what is included in the price, such as:

Accommodation, meals, taxes, transfers, tickets, activities, and service fees.

No service should be assumed to be included unless expressly stated.

Some cities or hotels may impose local taxes, deposits, or charges payable upon arrival.

6. Currencies

Prices may be displayed in Egyptian Pounds or foreign currencies.

Where payment is made in a different currency, the exchange rate applied by the bank or payment gateway at the time of the transaction will apply.

Any currency conversion shown on the website is approximate unless expressly stated to be the final binding rate.

10. Deposits and Partial Payments

Certain bookings may allow payment of a deposit or initial installment.

The price or availability is not secured except as stated in the quotation or booking confirmation.

The customer is responsible for paying the remaining balance by the applicable deadline.

Failure to pay on time may result in cancellation of the booking and application of the relevant cancellation terms.

11. Installment Payments

Installment services are subject to the terms and conditions of the relevant bank or financing provider.

The financing arrangement may be entered into directly between the customer and the financing provider.

The Company is not responsible for credit approval decisions or financing fees imposed by an independent financing provider.

12. Transaction Verification

The Company may request documents to verify the identity or authorization of the payment method holder, particularly where fraud indicators are present.

A transaction may be suspended or rejected where:

  1. It is declined by the bank.

  2. Verification cannot be completed.

  3. There are indications of fraud or unauthorized use.

  4. The transaction conflicts with applicable laws or banking regulations.

  5. Authorization from the payment method holder cannot be established.

13. Customer Responsibility for Information

The customer must carefully review:

Names exactly as shown in passports, dates of birth, nationality, passport numbers, dates, room type, meals, number of travelers, schedules, and destination.

The customer is responsible for costs arising from correction of information they provided incorrectly.

The Company remains responsible where it received correct information but entered or transferred it incorrectly.

14. Booking on Behalf of Others

The person making the booking confirms that they are authorized to provide the personal information of all travelers and to accept the applicable terms on their behalf.

The booking holder remains responsible for communication and payment unless the Company confirms another authorized person in writing.

15. Service Provider Terms

The terms and conditions of the hotel, carrier, travel company, event organizer, or other provider form part of the booking.

Material terms that may affect the customer’s decision, including cancellation, no-show, baggage, and age-related rules, will be disclosed before payment or included in the confirmation document.

16. Special Requests

Requests relating to views, bed type, connecting rooms, early check-in, or late check-out are recorded as requests only and are not guaranteed unless confirmed in writing by the supplier.

17. Invoices and Receipts

The Company issues documentation for amounts collected according to its role in the transaction.

The service provider may issue the invoice for the underlying service, while the Company may issue an invoice or receipt for marketing, booking, coordination, or service fees.

The fact that the Company collects the full amount does not necessarily mean that it is the actual service provider where the booking documentation clearly states that the Company acts as a collection agent or intermediary for a specified supplier.

18. Obvious Errors

Where a clearly incorrect price or description appears due to a technical or human error, the Company may correct it before final confirmation.

If the customer has already made a payment, the customer may choose between accepting the correction or receiving a refund for the unconfirmed request.

This clause may not be used to justify misleading advertising or intentional errors.

19. Electronic Communications

The customer agrees to the use of email, WhatsApp, text messages, and notifications for sending documents, confirmations, and amendments.

Electronically recorded communications, acceptances, payments, and confirmations may serve as evidence of the transaction to the extent permitted by law.

20. Corporate and Agent Services

B2B and B2B2C accounts are subject to separate commercial agreements and terms.

This Policy governs the calculation and processing of amounts due to customers following the cancellation or amendment of a booking, or where a service cannot be provided.

1. When Is a Customer Entitled to a Refund?

A right to a refund may arise where:

  1. The booking terms allow cancellation.

  2. The service provider approves the refund.

  3. The service is cancelled without an acceptable alternative being provided.

  4. An overcharge or duplicate payment occurs.

  5. The service cannot be delivered due to an error attributable to the Company.

  6. Applicable law provides a mandatory right to a refund.

Submitting a cancellation request does not automatically entitle the customer to a full refund.

2. Calculation of the Refund Amount

The refundable amount is calculated after deducting any permitted charges, which may include:

  1. Cancellation or amendment fees.

  2. The value of services already provided.

  3. Supplier fees.

  4. Governmental or consular fees.

  5. Non-refundable payment gateway or bank charges.

  6. Transfer fees and currency exchange differences.

  7. Non-refundable taxes.

  8. Disclosed consultation or processing fees for services already performed.

Where possible, the Company will provide the customer with a breakdown of the final refundable amount.

3. The Company’s Role and Its Effect on Refunds

3.1 Where the Company Is the Principal Contracting Party

The Company will refund the amount due in accordance with the booking terms and applicable law.

The Company may not rely on intermediary status where it contracted with the customer in its own name as the service provider or original seller.

3.2 Where the Company Acts as an Intermediary or Collection Agent

The Company will submit the refund request to the supplier and follow up on its processing.

The amount will be transferred to the customer after the refund has been approved and actually received from the supplier or payment gateway.

Where the Company’s intermediary role was clearly disclosed, it is not required to finance a refund amount that has not been returned by the supplier.

However, the Company remains responsible for reasonable follow-up and for transferring any amount received on behalf of the customer without unjustified delay.

4. Refund Processing Time

Refund processing begins after:

  1. A complete refund request has been received.

  2. The identity of the applicant has been verified.

  3. The refund amount has been determined.

  4. The supplier has approved the refund, where the Company acts as an intermediary.

  5. The Company or payment gateway has received the amount, where the refund depends on the supplier.

The Company aims to process the amount due within approximately 7 to 14 business days after completion of the above steps, or within any shorter period required by applicable law.

Banks or card providers may require additional time for the refunded amount to appear in the customer’s account.

6. Refund Method

As a general rule, refunds are made to the original payment method.

Where this is not possible for banking or legal reasons, a documented bank transfer may be made to the payment holder or an authorized beneficiary after identity verification.

Refunds will not be transferred to a third party without acceptable authorization.

7. Currencies and Exchange Rate Differences

Refunds are processed in accordance with the currency and method permitted by the collecting entity or supplier.

The final amount may differ due to exchange-rate movements or fees imposed by the bank or card network.

The Company is not responsible for differences arising solely from a bank or payment provider unless the error is attributable to the Company.

8. Non-Refundable Amounts

Non-refundable amounts may include:

  1. Accommodation rates or tickets clearly described as non-refundable.

  2. Governmental and consular fees.

  3. Event tickets and services reserved for a specific date.

  4. Issuance or processing fees for services already performed.

  5. Insurance premiums after coverage has commenced, subject to the insurer’s terms.

  6. The value of services already used in whole or in part.

  7. Payment charges not refunded by the collecting entity.

  8. Bookings lost as a result of a no-show.

  9. Fees clearly disclosed as non-refundable, to the extent permitted by law.

9. Partial Refunds

Where the customer has used part of the service, or the cancellation applies only to certain travelers, the refund will be calculated only for the refundable portion.

Cancellation by one traveler within a group booking may result in repricing of the remaining booking or loss of a group discount.

10. Visa Refusal

Visa refusal does not automatically create a right to a refund for hotels, flights, or travel packages.

Each service remains subject to its own cancellation terms unless the relevant offer expressly includes special protection in the event of visa refusal.

11. Vouchers and Credits

A credit or voucher may be offered with the customer’s consent or in accordance with the supplier’s terms.

A voucher cannot be converted into cash unless its terms or applicable law permit this.

A voucher may not be used to replace a mandatory legal right to a cash refund.

12. Chargebacks

Customers are encouraged to contact the Company first so the transaction can be reviewed.

A customer may not receive both a refund from the Company and a bank chargeback for the same transaction.

The Company may provide booking, payment, approval, and service-use documentation to the bank in order to defend a valid transaction.

If the customer receives the same amount twice, the customer must return the excess amount.

13. Overcharges or Duplicate Charges

If it is confirmed that the Company charged an excessive or duplicate amount due to its own error, the excess amount will be refunded after verification without cancellation fees.

Where the error originates from the bank or payment gateway, the Company will assist the customer by providing the necessary supporting documentation.

2. Definitions

For the purposes of these Terms, the following words and expressions shall have the meanings set out below:

Company: El Habashy Tourism & Investment, owner and operator of the EL HABASHY TRAVEL brand.

Platform: The website, application, social media pages, WhatsApp, email, booking center, or any other digital or physical channel operated by the Company.

Customer: Any person who uses the Platform, requests a quotation, makes a booking, or pays an amount.

Traveler: The person for whom the service is provided, whether or not that person is the Customer.

Supplier: Any hotel, licensed travel company, airline, carrier, medical facility, event organizer, booking platform, insurance company, or independent service provider.

Service: Any accommodation, trip, transfer, ticket, activity, program, visa service, coordination service, marketing service, or travel-related service.

Booking Request: A request submitted by the Customer that does not become confirmed until the confirmation requirements have been satisfied.

Booking Confirmation: The document, message, voucher, or ticket confirming final acceptance of the booking.

Specific Terms: Terms relating to a particular service, supplier, offer, or rate, including cancellation, amendment, refund, and no-show conditions.

3. Nature of EL HABASHY TRAVEL’s Business

EL HABASHY TRAVEL primarily operates as a tourism marketing, coordination, and facilitation platform providing access to travel, tourism, accommodation, leisure, and related services.

The Company’s role may vary from one transaction to another and may include acting as:

  1. A marketer of a service provided by an independent supplier.

  2. An intermediary or coordinator between the Customer and the Supplier.

  3. A booking agent or collection agent acting on behalf of the Supplier.

  4. A provider of administrative, marketing, or coordination services.

  5. A contracting party in its own name for a specific service, where legally permitted and clearly stated in the quotation or Booking Confirmation.

  6. A direct provider of certain services that fall within its permitted activities and responsibility.

The Company itself is not a hotel, airline, medical facility, embassy, consulate, insurance company, or carrier unless expressly stated otherwise in relation to a specific service.

Services requiring a specific tourism or professional license are provided through an appropriately licensed supplier, travel company, or entity, according to the nature of the service and applicable laws.

4. Identification of the Actual Service Provider

Where required or available, the quotation or Booking Confirmation will identify:

  • The actual service provider.

  • EL HABASHY TRAVEL’s role in the transaction.

  • The included services.

  • The price and payment method.

  • Amendment, cancellation, and refund terms.

  • Any material supplier-specific conditions.

The supplier’s name may be disclosed on the service page, quotation, invoice, voucher, ticket, or confirmation message.

5. Eligibility to Use the Services

Any person creating an account, making a booking, or entering into a financial obligation must be at least 18 years old.

An adult may make a booking on behalf of family members, employees, or other persons, provided that they are authorized to provide their data and accept the applicable terms on their behalf.

The booking holder is responsible for informing all travelers of the terms, details, schedules, and required documents.

6. Booking Requests

A service offered through the Platform may be:

  • Available for instant booking.

  • A booking request requiring review.

  • A request pending supplier confirmation.

  • A preliminary quotation.

  • A booking conditional upon payment or submission of documents.

Submitting a request, receiving an automated message, or making a payment does not mean that the booking is final unless a clear Booking Confirmation has been issued.

7. Booking Confirmation

A booking becomes confirmed after the necessary requirements have been satisfied, which may include:

  1. Service availability.

  2. Supplier approval.

  3. Payment of the required amount.

  4. Successful payment verification where required.

  5. Issuance of a confirmation number, voucher, ticket, or confirmation letter.

The Customer must review the confirmation immediately upon receipt and notify the Company of any error without delay.

8. Prices and Availability

Prices for hotels, flights, packages, activities, and tourism services may change according to availability, demand, supplier pricing, currency movements, and seasonality.

A price is not guaranteed until the booking is completed and confirmation is issued, unless the quotation expressly states that the price is guaranteed for a specified period.

If the price changes or availability is lost before confirmation, the Company may offer the Customer:

  • The revised price.

  • A suitable alternative.

  • A different date or service type.

  • Cancellation of the unconfirmed request and refund of any amount collected for it.

The Customer is not required to accept the revised price or alternative.

9. Obvious Pricing Errors

If a clearly incorrect price or description appears due to a technical, typographical, or supplier-data error, the Company may correct the error before final confirmation.

If payment was collected for a request that could not be confirmed because of an obvious error, the Customer may choose between accepting the correct price or receiving a refund of the amount paid for the unconfirmed request.

The Company may not rely on this clause to justify deliberate errors or misleading advertising.

10. What the Price Includes

Each offer will specify the services included in the price.

No service, tax, meal, transfer, or activity should be assumed to be included unless expressly stated.

Some hotels or local authorities may require a deposit, city tax, resort fee, or entry fee to be paid directly upon arrival.

The Company aims to disclose such charges whenever reliable information is available, although certain fees may change by decision of the supplier or competent authority.

11. Currencies and Exchange Rates

Prices may be displayed in Egyptian Pounds or foreign currencies.

Where payment is made in a currency different from that of the Customer’s card or account, the bank or payment gateway may apply its own exchange rate and fees.

Converted values displayed for convenience are approximate unless expressly stated to be the final binding amount.

The Company is not responsible for currency differences or charges imposed by the bank or card issuer unless caused directly by an error attributable to the Company.

12. Payment Methods

Available payment methods may include:

  • Bank cards.

  • Bank transfers.

  • Electronic wallets.

  • Payment links.

  • Cash payments where available.

  • Installment plans through financing providers or banks.

  • Any other payment method approved by the Company.

Only official payment methods designated by the Company should be used.

The Company does not request customers to send full bank card numbers or CVV security codes through WhatsApp or email.

13. Transaction Verification

The Company may suspend a transaction or request additional information to verify the payer’s identity or authorization where there are indications of fraud or unauthorized use.

An unconfirmed transaction may be rejected or cancelled where:

  • It is declined by the bank or payment gateway.

  • The identity of the payment method holder cannot be verified.

  • There are indications of fraud or misuse.

  • The transaction violates applicable law or anti-money laundering requirements.

  • Incorrect information or documents have been submitted.

Any amounts collected in such circumstances will be handled in accordance with the reason for cancellation, applicable law, and the Refund Policy.

14. Deposits and Partial Payments

Some bookings may allow payment of a deposit or initial installment.

The remaining amount must be paid by the deadline stated in the quotation or confirmation.

Failure to pay on time may result in cancellation of the booking and application of the supplier’s terms, including partial or full loss of the deposit where this was disclosed before payment.

Payment of a deposit does not guarantee all elements of the booking except as expressly stated in the confirmation.

15. Customer Responsibility for Accuracy of Information

The Customer must review all information before confirmation, including:

  • Names exactly as shown in passports.

  • Nationality.

  • Date of birth.

  • Passport numbers.

  • Passport issue and expiry dates.

  • Travel dates.

  • Destination.

  • Room type.

  • Number of travelers and children’s ages.

  • Meals and requested services.

The Customer is responsible for costs resulting from incorrect or incomplete information supplied by them, including amendment fees, reissuance fees, or price differences.

Where the Customer supplied correct information and it is established that the Company entered or transferred it incorrectly, the Company is responsible for addressing its error to the extent required by law.

16. Supplier Terms

The supplier’s terms form part of the booking, particularly terms relating to:

  • Cancellation and amendment.

  • No-show.

  • Baggage.

  • Check-in and check-out times.

  • Age requirements.

  • Deposits.

  • Dress codes or entry rules.

  • Health requirements.

  • Tickets and events.

  • Documents and visas.

Where a general term conflicts with a specific term clearly disclosed to the Customer before payment, the specific term will apply to the extent permitted by law.

17. Hotels and Accommodation

Accommodation services are subject to the policies of the relevant hotel or property, including:

  • Check-in and check-out times.

  • Children’s policies.

  • Extra beds.

  • Meals.

  • Deposits.

  • Use of facilities.

  • Smoking rules.

  • Pets.

  • Conduct rules.

Hotel classifications vary from one country to another.

Images and descriptions are based on information provided by the hotel or supplier, and certain facilities may change due to maintenance, seasonality, or operational circumstances.

18. Special Requests

Requests concerning views, floors, bed types, connecting rooms, early check-in, or late check-out remain unguaranteed requests unless confirmed in writing by the supplier.

The Company will attempt to forward the request to the supplier, but recording the request does not guarantee that it will be fulfilled.

19. Flights and Transportation

Flight tickets and transportation services are subject to the carrier’s rules and applicable fare class.

The traveler is responsible for:

  • Arriving sufficiently early.

  • Carrying the required documents.

  • Reviewing departure terminals and schedules.

  • Complying with baggage rules.

  • Meeting transit and entry requirements.

The carrier may change the schedule, route, arrival point, or type of transportation in accordance with its rules and applicable law.

Where the Company is not the actual carrier, it may assist the Customer in communication and obtaining available alternatives but cannot guarantee the carrier’s decision.

20. Trips, Activities, and Events

Day trips, activities, events, tickets, yachts, concerts, and sporting events are subject to the organizer’s terms and specified schedules.

Some tickets may be issued in the traveler’s name and may be non-transferable or non-cancellable.

The Customer must comply with entry, age, dress, security, and attendance requirements.

The Company is not responsible for refusal of entry resulting from the Customer’s breach of the organizer’s rules or submission of incorrect information.

21. Visas and Travel Documents

Visa-related services may include marketing, consultation, document review, coordination, appointment booking, or forwarding files to a travel company, visa center, or competent authority.

The decision to approve or refuse a visa, determine its duration or type, and determine the processing time rests solely with the relevant governmental authority, embassy, consulate, or other competent sovereign authority.

The Company does not guarantee issuance of a visa or issuance within a specific timeframe.

The traveler is responsible for ensuring:

  • Passport validity.

  • Accuracy of submitted documents.

  • Required visas.

  • Entry and transit requirements.

  • Vaccination or health requirements.

  • Travel permissions for minors.

  • Any legal restrictions relating to travel.

22. Hajj and Umrah

Hajj or Umrah programs requiring a license are provided only through licensed travel companies or authorized entities and in accordance with official systems and regulations.

The program or Booking Confirmation will identify the licensed operating travel company where required.

EL HABASHY TRAVEL may market, coordinate, or refer the Customer to the licensed company and is not considered the licensed operator of the trip unless expressly stated and the necessary license is held at the time of delivery.

23. Medical Tourism

Depending on the offer, the Company’s role in medical tourism services is limited to marketing, coordination, accommodation booking, transportation, or appointment scheduling.

The Company does not provide medical diagnoses or treatment advice and does not guarantee the outcome of any medical treatment or procedure.

The healthcare facility and treating physician remain responsible for diagnosis, treatment, medical approvals, and the quality of medical services.

24. Insurance

Where travel or medical insurance is offered, the insurance contract is between the Customer and the identified insurance company.

Coverage, exclusions, and claims are subject to the terms of the insurance policy.

Marketing the policy or assisting with its issuance does not guarantee acceptance of any claim.

25. Cancellation and Refunds

Cancellations and refunds are subject to:

  • The terms of the selected rate.

  • Supplier terms.

  • The date the request is submitted.

  • Type of service.

  • Whether the service has already been performed.

  • The Company’s role in the transaction.

  • The Cancellation Policy.

  • The Refund Policy.

There is no single cancellation rule applicable to all bookings.

26. Complaints

Complaints may be submitted to:

The complaint should include the booking number, a description of the issue, and supporting documents.

The Company aims to review complaints, communicate with the supplier where necessary, and provide an initial response within a reasonable period.

Submitting a complaint to a competent authority does not prevent attempts to resolve the matter amicably.

27. Company Responsibility

The Company is responsible for its own direct errors and express obligations, including:

  • Collecting and managing payments in accordance with its disclosed role.

  • Transmitting booking data correctly.

  • Performing services it has undertaken to provide directly.

  • Protecting data under its control.

  • Avoiding misleading advertising.

  • Handling complaints and amounts due in good faith.

Where the Company acts as an intermediary, it is not responsible for actions of an independent supplier that are outside the Company’s control, without prejudice to the Company’s responsibility for supplier selection, disclosure, collection of payments, or any other error attributable to the Company.

28. Limitation of Liability

To the maximum extent permitted by law, the Company’s liability for proven direct loss shall be limited to the value of the affected service or the amount of actual loss, as determined by the applicable legal rules.

No limitation of liability applies in cases of:

  • Fraud.

  • Intentional harm.

  • Gross negligence.

  • Personal injury arising from an error for which the Company is responsible.

  • Obligations that cannot legally be excluded or limited.

The Company is not liable for indirect losses, lost profits, or damage arising solely from the actions of the Customer, Supplier, authorities, or circumstances beyond reasonable control, except where applicable law provides otherwise.

29. Force Majeure

Force majeure and exceptional circumstances may include, by way of example:

  • Natural disasters.

  • Wars and civil unrest.

  • Epidemics.

  • Government decisions.

  • Border or airport closures.

  • Health restrictions.

  • Dangerous weather conditions.

  • General strikes.

  • Widespread booking or communication system failures.

  • Any event beyond the reasonable control of the parties.

The consequences of such an event will be determined according to applicable law, supplier terms, and whether the service can be performed, modified, or refunded.

Force majeure does not release any party from refunding an amount that has become legally due, although it may affect the form or timing of the available remedy.

30. Use of the Platform

The Platform must not be used for:

  • Fraud.

  • Submission of forged documents.

  • Use of a payment method without authorization.

  • Hacking or unauthorized access.

  • Impersonation.

  • Publishing unlawful or abusive content.

  • Reselling services without authorization.

  • Misuse of offers or promotional codes.

  • Threatening or abusing employees or suppliers.

The Company may suspend an account or reject requests where there is a legitimate reason, while settling financial rights in accordance with applicable law.

31. Intellectual Property

Rights in the trademarks, logos, designs, original content, software, and marketing materials belong to the Company or their respective licensed owners.

Content may not be copied or reused commercially without prior written permission.

32. Electronic Communications

The User agrees to receive booking, confirmation, payment, amendment, and notification messages through email, telephone, WhatsApp, or electronic notifications.

Electronic messages, recorded acceptances, payment records, and correspondence may serve as evidence of the transaction to the extent permitted by law.

33. Amendments to These Terms

The Company may amend these Terms for future use due to changes in services, laws, or operating methods.

A material amendment will not apply retrospectively to a confirmed booking unless required by law, more favorable to the Customer, or accepted by the Customer.

34. Severability

If any provision is found to be invalid or unenforceable, the remaining provisions will remain in force.

The affected provision shall be applied to the maximum extent that makes it consistent with applicable law and its legitimate purpose.

35. Governing Law and Jurisdiction

The Company is not responsible for the loss of a booking opportunity, expiration of an offer, or price change relating to a service that had not yet been finally confirmed where the inability to complete the transaction resulted from an event outside the Company’s reasonable control.

7. External Applications and Integrations

The Platform may use external applications or services for maps, analytics, advertising, messaging, email, customer relationship management, bookings, marketing, and social media.

Each service is subject to the terms and policies of its provider.

EL HABASHY TRAVEL is not responsible for:

  1. Failures or errors within an external application.

  2. Suspension or discontinuation of the application.

  3. Changes to its features, terms, or prices.

  4. A breach occurring exclusively within its systems.

  5. Independent data processing outside the Company’s instructions.

  6. Loss of data within a database not controlled by the Company.

  7. Technical conflicts caused by an external update.

  8. Suspension or restriction of a service by its provider.

This remains subject to there being no proven negligence by the Company in selecting the application, granting unnecessary permissions, or continuing to use it after becoming aware of a material unresolved risk.

8. Processing of Data by Technical Providers

Hosting providers, cloud infrastructure providers, and applications connected to the Platform may host, store, transfer, or process certain user data to the extent necessary to operate the website, accounts, forms, bookings, communications, security, and technical support.

Such data may include:

  1. Name and contact details.

  2. Account and login information.

  3. Form and request data.

  4. Booking and communication data.

  5. IP address.

  6. Device and browser type.

  7. Usage, security, and error logs.

  8. Cookies.

  9. Technical transaction data.

EL HABASHY TRAVEL remains responsible for the lawfulness of requesting the data, determining the purposes for which it is used, and obtaining any required consent, while the technical provider is responsible for the processing and systems under its control.

Data may be processed or stored in different countries depending on the operational infrastructure of providers and their subprocessors, subject to applicable legal requirements and safeguards.

9. Data Security and Shared Responsibility

Data protection is based on shared responsibility between EL HABASHY TRAVEL and its technical service providers.

The Company is responsible for:

  1. Managing employees and their permissions.

  2. Protecting its accounts and login credentials.

  3. Determining the data required.

  4. Training employees and requiring confidentiality.

  5. Managing its settings and applications.

  6. Responding to incidents under its control.

Each technical provider is responsible for protecting the servers, software, and infrastructure it operates.

The mere occurrence of a cyberattack or security incident does not, by itself, establish negligence by EL HABASHY TRAVEL. Responsibility is determined according to the cause and source of the incident, the measures taken, and the extent of each party’s contribution.

10. Payment Processing by Independent Financial Providers

Electronic payments are processed through independent local or international banks, payment gateways, card networks, electronic wallet providers, collection companies, or financing and installment providers.

When a customer enters card, account, or wallet information through a payment provider’s interface, that information is processed within the systems of the financial service provider, banks, and card networks according to their own terms, security policies, and legal requirements.

EL HABASHY TRAVEL does not normally retain full card numbers or CVV security codes, and customers should not send such information through WhatsApp, email, or any channel not specifically designed for secure payments.

11. Responsibility of Payment Service Providers

Depending on their respective roles, the bank, payment gateway, card network, wallet provider, or financing provider is responsible for:

  1. Receiving and processing payment data.

  2. Encrypting card data within its systems.

  3. Verifying the payer’s identity.

  4. Authentication and 3D Secure procedures.

  5. Approving, declining, or suspending transactions.

  6. Fraud prevention procedures.

  7. Holding or freezing funds.

  8. Settlement and financial transfers.

  9. Processing banking refunds.

  10. Disputes and chargebacks.

  11. Tokenization or storage of card tokens.

  12. Applying exchange rates and banking fees.

  13. Protecting the financial systems it operates.

12. Limits of the Company’s Responsibility for Payments

EL HABASHY TRAVEL is not responsible for the delay, rejection, suspension, freezing, duplication, or reversal of a transaction where this results directly and exclusively from:

  1. The card-issuing bank.

  2. The acquiring bank.

  3. The payment gateway.

  4. The card network.

  5. The wallet provider.

  6. The financing or installment provider.

  7. A banking or payment network outage.

  8. A verification or fraud-prevention procedure.

  9. Insufficient funds.

  10. Expiration of the payment method.

  11. A credit limit or banking restriction.

  12. Delayed settlement between financial institutions.

  13. Fees or currency differences imposed by the payment provider.

  14. A failure or breach occurring exclusively within an external financial system.

EL HABASHY TRAVEL remains responsible for:

  1. The accuracy of the amount it requests to collect.

  2. The description of the service provided in exchange for the amount.

  3. Amounts actually received into its accounts.

  4. Not retaining funds without a lawful basis.

  5. Processing refunds due in accordance with booking terms and applicable law.

  6. Correcting any duplication caused by incorrect instructions issued by the Company.

  7. Providing reasonable assistance in tracing a transaction.

The appearance of an amount as “pending” or “held” by a bank does not, by itself, prove that the amount has been received by the Company.

13. Travel and Tourism Service Providers

The actual service may be delivered by an independent supplier, including:

  1. A licensed travel company.

  2. A hotel, resort, or accommodation provider.

  3. An airline or carrier.

  4. A Destination Management Company.

  5. A tour or activity operator.

  6. A yacht or cruise company.

  7. An event organizer or ticket issuer.

  8. An insurance company.

  9. A medical facility.

  10. Any supplier identified in the quotation or Booking Confirmation.

The actual supplier is responsible for the part of the service it performs, including the quality and safety of delivery, its employees, facilities, equipment, licensing, and compliance with professional standards.

14. Responsibility of the Actual Supplier

Depending on the nature of the service, the supplier is responsible for:

  1. Availability of the service it confirmed.

  2. Quality of accommodation, transportation, or activities.

  3. Safety of its facilities, vehicles, and equipment.

  4. Cleanliness and operations within its premises.

  5. Check-in, check-out, and departure times.

  6. Changes to rooms, flights, or programs.

  7. Delivery of included meals and facilities.

  8. Baggage and transportation policies.

  9. Special requests.

  10. Conduct of its employees and representatives.

  11. Accidents arising from its facilities or transportation.

  12. Advertising or commitments issued directly by the supplier.

  13. Validity of licenses required for its activity.

EL HABASHY TRAVEL is not responsible for these matters where it acts as a marketer, intermediary, coordinator, booking agent, or collection agent, unless it provided an express guarantee in its own name, communicated information it knew to be inaccurate, concealed a material condition it knew about, or committed an independent error.

15. Services Provided in the Company’s Own Name

Where the quotation or Booking Confirmation states that EL HABASHY TRAVEL is the principal contracting party or service provider, the Company remains responsible to the Customer for the obligations it has undertaken, even where it uses a supplier or external system to perform the service.

The Company may not rely on outsourcing to avoid a contractual obligation that it expressly assumed in its own name.

16. Company Responsibility When Dealing with Suppliers

EL HABASHY TRAVEL remains responsible for:

  1. Clarifying its role in the transaction.

  2. Identifying the actual service provider where required.

  3. Correctly transmitting Customer data and requests.

  4. Providing available information without misleading the Customer.

  5. Not concealing material terms known to it.

  6. Handling funds in accordance with its disclosed role.

  7. Following up on complaints with the supplier within reasonable limits.

  8. Performing obligations undertaken in its own name.

  9. Correcting data-entry errors attributable to the Company.

  10. Not knowingly dealing with a supplier it knows is unlicensed to provide the required service.

17. Government Authorities and Visas

EL HABASHY TRAVEL is not responsible for decisions made by embassies, consulates, visa centers, immigration authorities, security authorities, customs authorities, or governmental bodies, including:

  1. Approval or refusal of a visa.

  2. Processing time.

  3. Requests for additional documents.

  4. Scheduling or cancellation of appointments.

  5. Issuing a visa with a different validity period or category.

  6. Temporary retention of a passport.

  7. Refusal of entry.

  8. Changes to entry or transit requirements.

  9. Any security or sovereign decision.

The Company remains responsible for its own direct errors in any review or coordination service it has undertaken, without guaranteeing the decision of the competent authority.

18. Medical Services

Hospitals, medical centers, physicians, and treatment providers operate in their independent professional capacity.

The medical service provider is responsible for:

  1. Diagnosis.

  2. Determining treatment.

  3. Explaining risks and alternatives.

  4. Obtaining medical consents.

  5. Tests, procedures, and operations.

  6. Outcomes and complications.

  7. Prescribing medication.

  8. Reports and follow-up.

  9. Compliance with medical licensing and professional standards.

EL HABASHY TRAVEL does not provide medical diagnosis or treatment and does not guarantee any medical outcome. Depending on the offer, its role is limited to marketing, coordination, appointment scheduling, accommodation, and transfers.

19. Communication and Social Media Platforms

The Company may communicate through email, WhatsApp, text messages, social media platforms, and telephone networks.

The Company is not responsible for:

  1. Failure of an independent communication platform.

  2. Delayed delivery of messages caused by the service provider.

  3. Blocking or suspension of an account by an external platform.

  4. Hacking of the Customer’s device or account.

  5. The Customer sending data to an unofficial account.

  6. Interception of a message outside systems controlled by the Company.

  7. Changes to the policies or features of an external platform.

The Company remains responsible for protecting data after it is received within its own systems and for taking reasonable steps to secure its official accounts.

20. Information Provided by Suppliers

Certain prices, images, descriptions, ratings, schedules, locations, and operational information may be based on data supplied by a supplier or external system.

EL HABASHY TRAVEL uses reasonable care to communicate available information accurately, but does not guarantee that such information will remain unchanged where its updating or issuance is controlled by an external party.

The Company is not responsible for inaccurate information independently supplied by a supplier unless the Company knew it was inaccurate, the error was obvious and could not reasonably be ignored, or the Company presented the information in a misleading manner.

21. Circumstances Beyond Reasonable Control

EL HABASHY TRAVEL is not responsible for delays or inability to perform resulting from circumstances outside its reasonable control, including:

  1. Power, internet, or telecommunications outages.

  2. Failure of a technical provider or cloud system.

  3. Failure of banks or payment gateways.

  4. Failure of Global Distribution Systems.

  5. Large-scale cyberattacks.

  6. Governmental or judicial decisions.

  7. Wars, civil unrest, or terrorism.

  8. Epidemics and natural disasters.

  9. Border or airport closures.

  10. Health or security restrictions.

  11. Dangerous weather conditions.

  12. Strikes by suppliers or carriers.

The Company will make reasonable efforts to minimize the impact of the event and follow up on available alternatives or refunds according to supplier terms and applicable law.

22. Indirect Losses

To the extent permitted by law, EL HABASHY TRAVEL is not responsible for indirect, incidental, consequential, or special losses, or loss of profits, opportunities, business, or reputation, where such loss is not the direct and reasonably foreseeable result of a proven error by the Company.

23. Liability That Cannot Be Excluded

Nothing in this section should be interpreted as excluding the Company’s liability for:

  1. Fraud or fraudulent misrepresentation.

  2. Intentional harm.

  3. Gross negligence.

  4. Misleading advertising.

  5. Retaining funds without lawful basis.

  6. Disclosure of personal data resulting from a proven breach by the Company.

  7. Personal injury resulting from an error for which the Company is legally responsible.

  8. Any liability that cannot legally be excluded.

  9. Mandatory rights of consumers or data subjects.

24. No Direct Obligation Created for Third Parties

Nothing in this section is intended to create a contract, guarantee, or direct obligation between the Customer and any technical provider, bank, payment gateway, application, or external supplier unless the Customer has entered into a separate agreement with that party or the party is expressly identified as the actual service provider.

Each party’s responsibility remains subject to its own contracts, policies, and applicable law.

25. Priority of Applicable Law

If any provision of this section conflicts with a mandatory rule of law, the mandatory legal rule will apply to the extent of the conflict, and the remainder of this section will remain in effect.
